Virgin Radio Teens Club Culture

Virgin Radio's Teens Club Culture (TCC) is managed by TEN Total Events Network FZ LLC (TEN) as a promotional marketing membership for our participating venues and partners running events for 13 - 17 year olds.

By signing up your teenager for membership to Teens Club Culture you are confirming your agreement to these TCC Terms and Conditions and that you are the parent or legal guardian of the teenage member and that they are within the age limits set out below.

Memberships

TCC Special Offers are made available at certain times for the online purchases of TCC Memberships at AED350. These special offers are not valid in conjunction with any other offers such as discounted payments for ADCB or use of unique codes from Memberships purchased in Virgin Megastore.

Any Teenager between 13 and 17 years old can join TCC. Members can join on their 13th birthday.

Teenagers who turn 18 before 1st September 2012 are ineligible to join TCC.

Teenagers who turn 18 after 1st September 2012 can join TCC until 1st September 2013. . Any teenager who is 18 or turns 18 before 1st August 2013 will be have their membership terminated on 1st September 2013, irrespective of if they have not been a member for a full 12 months.

TCC membership is an annual subscription which includes the TCC Membership Pack, discounts to all weekly gigs and events, access to all areas on www.teensclubculture.ae and loads of news, reviews, weekly competitions and giveaways.

Membership is renewed on an annual basis by paying the subscription online at www.teensclubculture.ae

TCC Visa Prepaid Cards will be distributed from August 2012 via courier - a parental ID must be uploaded for the TCC Visa Prepaid Card to be allocated, delivered and activated.

We will send TCC members and their parents a reminder by email 1 month prior to your renewal month with details of your membership benefits. Should you choose not to renew your membership then any monies on the TCC Visa Prepaid Card will be retained by TCC.

On renewal of membership all the expiry date of the TCC Visa Prepaid Card will be extended for another year.

Access to the website, promotional offers and TCC special events promoted through TEN Total Events Network FZ LLC and TCC are only available for TCC members using their password.

TCC members are only permitted discounts or special offers at venues or events if their valid TCC membership card is presented.

The TCC discounts or value-add benefits for TCT members at participating venues are not available in conjunction with other offers the participating venues are running at that time.

Beyond the control of TEN, some memberships and/or prepaid card activation may be declined subject to the TCC Visa Prepaid Card issuers Terms & Conditions and/or guidelines prescribed by local and/or global authorities, which are subject to change from time to time.

We reserve the right to ask for proof of age from members at anytime.

ADCB TALENTED TEENS

ADCB Talented Teens Competition Terms & Conditions

TCC Talented Teens will commence on 1st April 2012 and the winners will be announced on September 28th.

All competitors must be aged between 13 and 18 years old on 28th September 2012.

All competitors must be resident in the UAE but all nationalities can take part.

Entry details for each category can be found online at www.teensclubculture.ae

You can select to take part in as many categories as you would like and make multiple submissions or attend multiple auditions or workshops.

TCC or the Judges can not be held responsible for submissions that are sent but not received.

Competitors do not need to be members of Teens Club Culture.

The Judges decision is final at all stages of the competition and correspondence will not be entered in to.

The prizes will be awarded by ADCB on 28th September 2012.

Prizes awarded have a cash value of US$2,500 per prize. The prize money must be allocated towards the advancement of the individual talent being rewarded. The allocation of the prize money will be at the discretion of the ADCB Talented Teens Committee.

Copyright to any and all submissions remains with the competitor, however each competitor agrees to permit the use of the content of the submission to TEN Total Events Network FZ LLC and ADCB for use in perpetuity for commercial and non-commercial purposes, including but not limited to names, photos, film, audio and document files or images.

We reserve the rights to publish in perpetuity all and any submissions through any communication channels by Ten Total Events Network FZ LLC or ADCB.

There are no fees or charges made to competitors to enter into ADCB Talented Teens however TEN Total Events Network or ADCB will not cover the individual expenses incurred related to taking part in the competition for the avoidance of doubt: travel expenses, material or equipment.

T&Cs are subject to change. Any changes will be notified on the TCC website only.

Family members of ADCB or TEN Total Events Network employees can take part in the competition but will not be eligible to win the financial prize from ADCB, which would in this instance, be donated to a charity selected by ADCB.

TCC EVENTS

By confirming your agreement to TCC Terms and Conditions you are agreeing that you and your teen will adhere to and agree to the individual rules, regulations, and terms and conditions of venue entry and use of venue equipment at any TCC event that you or they attend.

You understand that for some TCC events where the activity could be potentially dangerous, e.g. Automotive Sport, that the teenagers or their parents/guardians may be required to sign additional waivers at the venue.

TEN will endeavour to ensure that the Event Diary is accurate and that all participating venues present their Special Event as marketed and promoted on TCC website and that they continue to offer member benefits throughout the year. If any participating venue does not fully satisfy your TCC membership benefits as marketed then please advise TEN and we will endeavour to rectify the issues.

Participating venues may choose to withdraw from marketing their special events through TCC and TEN in which case TEN will endeavour to substitute special events in the diary and alternative venues.

TEN will not be responsible for any participating venues withdrawing during the term of your annual membership or in participating venues changing their terms and conditions, availability for Special Events or member's benefits.

Members may have new benefits at additional participating venues offered to them during the term of their membership and these will be notified online at www.teensclubculture.ae and in newsletters.

By attending TCC events, members and their parents/guardians acknowledge that their image may be captured as a picture, audio or video and that pictures, images, videos may be uploaded onto www.teensclubculture.ae or the TCC facebook, youtube or twitter accounts for public viewing. By agreeing to these terms and conditions you are allowing the use of your image or teenagers image taken at TCC events to be used by TEN for all and any marketing and promotional activity for TCC in perpetuity.

First Aid & Emergency Contacts

The contact telephone number provided during the membership registration process will be used by TEN or associated TCC Event venues to contact the parent or guardian in the case of an emergency.

You agree that should we be unable to contact a parent or guardian within a reasonable time frame and that should immediate first aid treatment be required, that TEN representatives or TCC Event Venue representatives will be permitted to administer emergency first aid treatment.

Contact using the telephone numbers provided will be made with the parent or guardian as quickly as possible to seek further permissions and to communicate any first aid requirements or further proposed treatment or action.

Communication & Data

TEN Total Events Network will not be liable for any non-receipt of communication to members including renewal reminders.

TEN reserve the right to communicate with TCC members by email and telephone to update TCC members on TCC benefits, Special Events and general communication.

TEN will not spam TCC members or their parents/guardians on email or telephone and will limit communication to TCC relevant messages from TCC or participating venues or partners.

TEN reserve the right to communicate directly with the parents or legal guardians of TCC members regarding TCC benefits, Special Events, general communication and any specific benefits or offers for TCC member's parents or legal guardians.

TEN reserve the right to communicate directly with parents regarding any inappropriate behaviour issues by TCC members that are in violation of the TCC General Rules and if required to request the collection of TCC members from Special Events and or revoke membership from TCC.

TEN may monitor and record communications for training and evidential purposes. Please email info@teensclubculture.ae for further information on this.

Data Protection

TEN ensures that all data received from members of TCC or visitors to TCC website or members of the public who register email addresses or any other personal data, will be held securely and in accordance with standard international data protection protocol. Information may be disclosed if officially requested by local authorities, including but not limited to local police.

Members' private details and visitation data for each participating venue may be used for research purposes by TEN only.

Members private details will not be sold or given to a 3rd party at anytime and will only be used to promote specific special events and promotions to members on behalf of participating venues and partners and their portfolios of services or venues.

TEN cannot guarantee that participating venues or partners will not undertake data-capture exercises at Special Events and then communicate directly with members or their parents/guardians. Any abuse of this communication should be reported to TEN.

General Policies & Rules

  • On-line engagement with and between TCC Members will be monitored by a TEN employee or REP and any abuse by any party will be reported and any inappropriate online content removed as soon as possible.
  • We operate a '3 strikes' Rule for TCC members for inappropriate behavior on or off-line - at which time parents will be contacted and membership or some membership may be revoked.
  • TCC Event Entry is in accordance with our Admission Policy and the age restrictions are strictly adhered to. TCC events are only for people who are 13 to 17 years old. Any person wishing to gain entrance is asked to produce their Members Card or appropriate photo ID (non- members)
  • Soft drinks, water and juices will be on sale or made available by sponsors. Food will be on sale where appropriate.
  • No alcohol branding is displayed and no alcohol is sold or dispensed at any event
  • No Tobacco or Cigarette branding is displayed, no tobacco or cigarettes are sold or displayed and smoking is prohibited at all events within TCC event areas (this does not apply in public areas where we are not controlling the location)
  • There will be appropriately qualified First Aiders at every event
  • All venues will have the TCC search policy on display or available on request. TCC reps or the venues staff reserves the right to carry out searches of customers attending these events. Searches will usually take place on the door and are primarily undertaken to prevent weapons, alcohol and illegal substances being brought into any Venue. Any persons that refuse to be searched are not permitted to attend any TCC events.
  • Searches will be conducted in accordance with the venues approved searching policy
  • Should we or the venue have to refuse entry to any person or ask an attendee to leave a TCC event or any reason, including, without limitation, inappropriate behavior, then we will take all reasonable steps to ensure that any such person will be supervised by the staff at the Venue until their parents/guardians and/or local authority are telephoned and arrive to collect them
  • TCC do not operate a managed 'pick up' service for TCC members. The arrival and departure of TCC members is not monitored on check-lists unless we feel that a TCC member is behaving inappropriately or if we have concerns regarding their emotional or physical wellbeing.
  • Should we or the venue have concerns in circumstances where it is thought that that young person is vulnerable because of drug, alcohol or emotional difficulties then we will take all reasonable steps to ensure that a parent, guardian or local authority is contacted.
  • Other than in exceptional circumstances only people who are employed to work at or supervise the event will be present at the Venue. We do not permit any customers over the age of 18 to these events although we are committed to liaising openly with parents and carers
  • As well as venue staff, TCC REPS will be employed to host and attend every event. These REPS will be aged between 18-21 years old and will :-

    Treat all young people with respect and dignity
    Ensure that the welfare and safety of customers is paramount at all times
    Always act in a professional way
    Not accept bullying, swearing or other disruptive behavior from any customer
    Liaise openly with parents and guardians
    Listen to, and act upon, any allegations or concerns of which they become aware in
    relation to young people attending our events
    Ensure all of our events are fun and enjoyable

TCC REPS will also be subject to strict contractual terms and conditions. The REPS will also adhere to and uphold the TCC policies and there will be a zero tolerance for drinking, drugs, smoking, swearing or behaving in a manner not appropriate when working with teenagers. The REPS will not be permitted to develop friendships with TCC members.

TCC MEMBERSHIP CARD

The TCC Membership Card is proof of membership, is non-transferrable and must be signed to be valid.

From July 2012 the TCC Visa Prepaid Cards issued -and these will replace the TCC Membership Card.

The card remains the property of TEN Total Events Network FZ LLC until annual subscription payments have been made and the card is successfully activated.

TEN will re-issue lost or stolen cards once notified by a member calling the customer service number or contacting us directly. Replacement cards will be charged at AED20 and remaining balances will be transferred to the new card. Replacement cards can be collected free of charge from the office on request or sent by courier for a charge.

Card Charges & Fees

The TCC Visa Prepaid Card will be issued with a minimum opening balance of AED50 per card. This can be used at any point of sale location that takes VISA cards in the UAE and internationally. This card cannot be used in cash machines.

A fee of AED2 will be charged per transaction.

Please see TCC Card section for full details of card use, charges and benefits. Full Terms & Conditions of the card and its use will be included in each membership pack and are subject to change from time to time without prior notification.

Visa Prepaid Card Terms & Conditions

DEFINITIONS

Card means the TCC Visa Prepaid Card issued to you by Us
Expiry Date means the date on which Your Card will cease to work.
Service & Price Guide means a separate leaflet describing the specific features, terms, conditions and fees that apply to Your Card.
We, Us or Our means TEN Total Events Network FZ LLC or Abu Dhabi Commercial Bank PJSC acting on TENs behalf, and their successors and assignees.
You or Your refers to the cardholder

1. INFORMATION ON WHO WE ARE AND THIS AGREEMENT
1.1 This document sets out the general terms and conditions that apply to the TCC Visa Prepaid Card. This document must be read in conjunction with the Service & Price Guide, which describes the specific features, terms, conditions and fees applicable to Your Card. Together, these documents form an agreement between You and Us governing the possession and use of the Card. Your use of the Card shall constitute an agreement by You to pay any and all fees, commission and charges on all Card transactions.

1.2 Cards are issued by Abu Dhabi Commercial Bank pursuant to a license from Visa Inc.

1.3 The production of the Cards and the technology systems required to operate the Cards are provided by TEN Total Events Network FZ LLC and Global Processing Services FZLLC. TEN Total Events Network FZ LLC also provides customer support for Cards as set out in paragraph 13 below.

1.4 This agreement will last for a period of 5 years or until the Expiry Date of your Card is reached, whichever happens sooner. This agreement and all communications between Us and You shall be in the English language.

1.5 In some cases, the TCC Visa Prepaid Card will be distributed by one of Our commercial partners. Whilst Our commercial partner may distribute the Card, this agreement is separate and distinct from any other agreement You may have with Our commercial partner.

2. CARDS
2.1 The Card is a prepaid payment Card which may be used to pay for goods and services at participating retailers that accept Visa cards, subject to there being sufficient funds on the card to pay for the goods and services. It is designed for us in shops and retail locations where you are physically present. ATM, Telephone mail order and internet transactions are prohibited. Like any payment Card, We cannot guarantee that a particular retailer will accept the Card please check with the retailer before attempting the transaction if You are unsure.

2.2The Card is intended for use as a means of payment, and funds loaded onto the Card do not constitute a deposit. You will not earn interest on the balance of the Card. The Card will expire on the Expiry Date and will cease to work. Please check the Service & Pricing Guide and section 8 of this document for further information.

2.3 The Card will normally be ready for use one hour after activation. If you are unable to use your Card after this period please contact Customer Services on +971 04 422 4920

3. IDENTIFICATION REQUIRED FOR PURCHASE OF CARDS
3.1 You must have uploaded a valid passport or other legally acceptable form of identification as per Our requirements online atwww.teenclubculture.ae. We will retain a copy of this identification in our online database. The purchase of or use of the Card will indicate to Us that You warrant the factual accuracy of all information provided about You during the Card application. If it is subsequently discovered that any information provided is falsified or inaccurate, We reserve the right to cancel the Card immediately without further notice.

3.2The Card is a financial services product, and We are therefore required to hold certain information about Our customers. We use this information to administer Your account, and to help Us identify You and Your Card in the event that it is lost or stolen. We only keep this information as long as is necessary and for the purposes described. Please see Section 15 for more information.

3.3We require evidence of who You are and reserve the right to ask You to provide some documentary evidence to prove this and/or We may carry out checks on You electronically. When We carry out these checks, Your personal information may be disclosed to anti-money laundering or fraud prevention agencies and other organisations as deemed fit by Us. The purchase of or use of the Card will indicate to Us that You consent to the checks described in this agreement being undertaken.

4.FEES AND CHARGES
4.1The fees and charges associated with this Card form an integral part of these terms and conditions. All fees and charges are described in the Service & Price Guide which will be issued to You along with these terms and conditions. 5. HOW TO USE THE CARD
5.1 A Card may only be used by the person to whom the Card was issued or a minor whom the Parent/Guardian have permitted to use the Card. The Cards are otherwise non transferable. The Parent/Guardien is solely responsible and liable for the cards usage and to whom they grant authority to usage to. ADCB and TEN Total Events Network FZLLC are not liable for useage by any unauthorised persons.
Prior to use, the Card should be signed by the Parent/Guardian or the minor they have approved usage of the Card, on the signature stripe located on the back of the Card

5.2 All transactions performed using the Card (whether in UAE Dirhams or another currency) will be subject to individual, daily and other limits imposed by Us from time to time and subject to change without prior notice.

5.4 You accept Our record of Card transactions as binding and conclusive for all purposes and We will be entitled to assume that a transaction was authorised by You where
5.4.1 the magnetic stripe on the Card was swiped by a retailer or the Card was inserted into a chip & PIN device or
5.4.2 the Card PIN was entered into a chip & PIN device or a sales slip was signed, or

5.5 Normally, We will receive notification of Your authorisation by way of an electronic message in line with the rules and procedures of the payment scheme (Visa network). Once We have received Your instruction to proceed with the transaction, the transaction cannot be stopped or revoked. Please refer to Section 12 of this agreement for more information. We will deduct the value of the transaction, plus any applicable fees and charges, from the remaining balance of the Card. The retailer or service provider that has accepted Your Card for payment will normally receive payment within 5 working days.

5.6 Under normal circumstances, if any payment is attempted that exceeds the remaining value on the Card the transaction will be declined. You are solely responsible for ensuring Your Card has sufficient funds for any intended Card transaction. In certain circumstances, a transaction may take Your Card into a negative balance this will normally be where the merchant has failed to seek authorisation for the transaction. In these cases, We will attempt to recover some or all of the money from the merchant if We can, without assuming any responsibility thereof, providing that We are satisfied that You have not deliberately used the Card in the manner that would result in a negative balance. We will deal with such instances on a case by case basis, but where there is an outstanding shortfall on the balance, We may require you to bring Your Card balance back into good standing by making up the shortfall. Until Your Card is in good standing, We may restrict or suspend the use of Your Card.

5.7 The Card may be used in full or part payment for purchases. In the case of part payment, the cardholder will be required to pay the outstanding amount of the purchase by an alternative means, for example, cash or another payment
card.

5.8 If You use a Card for a transaction in a currency other than the currency that the Card is denominated in, the transaction will be converted to the currency that the Card is denominated in by the Visa scheme network at a rate set by Visa Inc. The exchange rate varies throughout the day and is not set by Us, therefore We are not responsible for the rate received. You can ask Us for information about the exchange rate used after the transaction has been completed by contacting Customer Services.

5.9 Normally, We will be able to support transactions 24 hours per day, 365 days per year. However, We cannot guarantee this will be the case, and in certain circumstances for example a serious technical problem We may be unable to receive or complete transactions.

6. RESTRICTIONS ON USE OF CARD

6.1 A Card is not linked to a bank deposit account and is not a cheque guarantee card, charge card or credit card, nor may it be used as evidence of identity.

6.2 A Card may not be used for preauthorised regular payments, or for any purpose which is not legally permitted as per the law of the jurisdiction where the Card is being used, e.g. gambling etc..

6.3 Use of a Card may be restricted without notice if suspicious, fraudulent or illegal activities are identified or suspected, if We believe You have not complied with these terms and conditions, or in the event of exceptional circumstances which prohibit the normal operation of the Card.

6.4 The Card may only be loaded via channels that We approve. The type and nature of these load channels will depend on the commercial relationship We have with Our partners. We will describe these load channels applicable to Your Card in the Service & Price Guide, however should You have any questions about ways to load Your Card please contact Customer Services.

6.5 Where You choose to reload by way of cash or use any other channel or facility provided by Us to reload, You will be solely responsible for advising the correct Card number or customer reference number to which the payments are to be made. We shall not be liable for any
inaccurate transfer of funds due to Your error/incorrect advice. We shall not be a party to queries or disputes regarding excess, insufficient, late or incorrect transfer/payment or disputes of any nature whatsoever, which may arise.

6.6 If the reload amount exceeds the maximum balance permitted by Us and subject to change from time to time, We reserve the right to refuse to reload such excess amount. We are authorised to withhold any reload, and will not release the funds in relation to such reload, if We have reasonable grounds to believe that such funds are from suspicious, illegal or illegitimate sources.

7. MANAGING YOUR CARD & ACCOUNT
7.1 You may check the available balance on Your Card or view a statement of recent transactions by visiting www.teensclubculture.ae and logging into your account or alternatively You may call Customer Services for this information in accordance with Section 13 below.

8. EXPIRY OF THE CARD
8.1 Your Card will expire 12 months following activation. This is different to the date printed on the face of the Card. In some cases, We may extend the Expiry Date or issue a new Card to You shortly before the Expiry Date, however We are not obligated to do so, and may elect not to issue a replacement Card at Our sole discretion. Any arrangements for the issue of a replacement Card will be described in the Service & Price Guide..

9. CANCELLATION AND REDEMPTION PROCEDURE
9.1 Should You wish to cancel Your Card and this agreement please return the Card to Us unsigned and unused within 14 days of issue and a full refund of any fees paid to date will be made minus a cancellation fee of AED50. Note that You will not be entitled to a refund of any fees if You have used Your Card during the 14-day cooling off period.

9.2 After 14 days from the date of purchase You may redeem some or all of the remaining balance of the Card by writing to Us, minus the Cancellation Fee of AED50. We will not complete Your redemption request if We believe You have provided false information, or We are concerned about the security of the transaction, if Your account is not in good standing, if there are insufficient funds to cover the redemption and cash-out fee, or for any other valid reason.

9.3 If You request redemption of the entire remaining balance in accordance with conditions 9.1 or 9.2, We will interpret this as Your withdrawal from this agreement and We will cancel Your Card.

9.4 We may cancel this agreement:
9.4.1 if Your Card reaches its Expiry Date, and We have decided not to extend the Expiry Date or issue You with a new Card at Our sole discretion;
9.4.2 if You break an important part of this agreement, or repeatedly break the agreement and fail to resolve the matter within 3 days (where resolution is possible), or use Your Card or account or any of its facilities in a manner that We believe is fraudulent or unlawful;
9.4.3 if You act in a manner that is threatening or abusive to Our staff, or any of Our representatives;
9.4.4 if You fail to pay fees or charges that You have incurred or fail to put right any shortfall;
9.4.5 if there is no activity on Your Card for a period of 3 consecutive months or more;
9.4.6 after 60 months, at the natural end of this agreement

10. KEEPING YOUR CARD AND DETAILS SAFE
10.1 You are responsible for keeping Your Card and its details safe. We will assume that all transactions entered into by you using Your card or Your card details are made by You. Therefore You must take all reasonable steps to avoid the loss, theft or misuse of the Card or details. Do not disclose the Card details to anyone except where necessary to complete a transaction. You should be happy that the retailer or service provider is genuine and has taken adequate steps to safeguard Your information before proceeding with the transaction and supplying them with the physical Card or details

11. LOST, STOLEN OR DAMAGED CARDS
11.1 If You lose Your Card or it is stolen or damaged please notify Us immediately by telephoning Customer Services in accordance with Section 13 of this agreement. You will be asked to provide the Card number and information to verify that You are the authorised cardholder. Following satisfactory completion of the verification process, We will then immediately block any lost or stolen Card to prevent unauthorised use and cancel any damaged Card to prevent further use. We are authorised to report the loss to the relevant local law enforcement authorities. We will not be held responsible for any misuse of the stolen Card before it is blocked by us as shown above.

11.2 If We believe You have acted fraudulently, or if We believe You have intentionally or with gross negligence failed to keep Your Card or its details safe at all times, We will hold You liable for all transactions and any associated fees.

11.3 You are liable for all transactions performed on the Card until it is reported lost/stolen to the call centre and blocked accordingly.

11.4 After You have notified Us of the loss, theft or risk of misuse, and providing that We are able to identify Your Card and satisfy certain security checks, We may issue a replacement Card and/or PIN to You. Certain fees may apply for the re-issue of a lost or stolen card, please see the Service & Pricing Guide for details. The cooling off period described in Section 9.1 does not apply to replacement cards.

11.5 In the event that You recover any Card reported as lost or stolen You shall immediately return the same cut in half, to US at the address on the reverse of the Card, without using it. You shall not use Your PIN after its disclosure to any party.

12. PURCHASES FROM RETAILERS AND TRANSACTION DISPUTES
12.1 We are not responsible for the safety, legality, quality or any other aspect of the goods and services purchased with the Card.

12.2 If You believe You did not authorise a particular transaction You should notify Us of the dispute by contacting Customer Services at the earliest opportunity.
12.2.1 If You identify a transaction that You believe was unauthorised or incorrectly carried out, You must notify Us without undue delay and in any event, not more than 1 month after the date of the transaction. You must tell Us as soon as You notice the problem.
12.2.2 In accordance with 12.2.1 You must notify Us of unauthorised or incorrectly executed transactions by completing a dispute declaration form that we will provide to you. No other method of notification will be considered valid. The day on which we are notified of the unauthorised or incorrectly executed transaction will be the day on which we receive the completed declaration form from you.
12.2.3 In certain circumstances, We may be able to assist You with a dispute and we may be able to recover the value of the disputed transaction. Such instances will be handled on a case-by-case basis, and We cannot guarantee that We will be able to help in every case, though We will use all reasonable endeavours where We can. We shall not be held liable for a transaction that has been incorrectly executed if You have failed to notify Us of a problem without undue delay in those circumstances, You may be held liable.

12.3 In certain circumstances, a transaction will be initiated but not fully completed. Where this happens, this may result in the value of the transaction being deducted from the Card balance and therefore unavailable for use We refer to this as a hanging authorisation or block. In these cases, You will need to contact Our Customer Service team and present relevant evidence to show that the transaction has been cancelled or reversed.

12.4 Where a retailer provides a refund for any reason (for example, if You return the goods as faulty) it can take several days for the notification of the refund and the money itself to reach Us. As such, please allow 5-10 days from the date the refund was carried out for the refund to be applied to Your Card.

12.5 We reserve the right to approve or decline any Card transaction. In certain circumstances, We may refuse to complete a transaction that You have authorised. These circumstances include:
12.5.1 if We are concerned about the security of Your Card or We suspect Your Card is being used in a fraudulent or suspicious manner
12.5.2 if sufficient funds to cover the transaction and all associated fees are not available at the time that We receive notification of the transaction
12.5.3 if there is an outstanding shortfall on the balance of Your Card
12.5.4 if We have reasonable grounds to believe You are acting in breach of this agreement
12.5.5 errors, failures (mechanical or otherwise) or refusals by merchants, payment processors or payment schemes processing transactions

12.6 As part of fraud prevention procedures, We may contact You by phone/SMS on the mobile telephone number you provided to us on application, requesting particular details of a transaction and/or additional proof of Your identification. In case we are unable to reach you due to your non-updated details with us, We shall take all the measures we deem adequate in this respect. Therefore it is important You regularly ensure We have Your up-to-date telephone number and email address on record. You can update your account online at www.teenscubculture.ae

13. CUSTOMER SERVICES

13.1 Our Customer Services team are normally available 9am to 5pm every day excluding public holidays. During these hours We will endeavour to resolve all enquiries immediately, however please note that certain types of enquiry can only be resolved during normal business opening hours. 13.2 Our business opening hours are Sunday to Thursday, 9am to 5pm. Correspondence received after the close of business on a particular day will be treated as having arrived on the following business day.

13.3 In addition to the above you may also perform a balance enquiry by SMS. To request your balance by SMS please send a message from your mobile telephone to +971 055 960 2806 starting with BAL followed by the 9 digit number in the bottom left corner of Your Card e.g. BAL 123456789. We will return your balance by SMS to your mobile telephone. Please note that you may be charged for sending or receiving SMS messages by Your provider at the standard rates that apply to Your contract with them.

13.4 If You are not satisfied with any element of the service You receive, any complaints should be made to Customer Services using the contact details in Section 13.1 above. Calls may be monitored or recorded.

14. LIMITATION OF LIABILITY
14.1 None of the organisations described in Sections 1.2 and 1.3 will be liable for:
any fault or failure relating to the use of the Card that is a result of abnormal and unforeseeable circumstances beyond our control which would have been unavoidable despite all our efforts to the contrary, including but not limited to, a fault in or failure of data processing systems.
the goods or services that you purchase with your Card.
any loss of profits, loss of business, or any indirect, consequential, special or punitive losses.
any acts or omissions that are a consequence of our compliance with any national or international law. In any event the liability of the organisations described in Sections 1.2 and 1.3 will be limited to the balance of the Card at the time that the event occurs.

14.2 In addition to the conditions set out in section 14.1, Our liability shall be limited as follows:
Where your Card is faulty due to our fault, our liability shall be limited to replacement of the Card or, at our choice, repayment to you of the Available Funds.
Where sums are incorrectly deducted from your available funds due to our fault, our liability shall be limited to payment to you of an equivalent amount.
In all other circumstances of our fault, our liability will be limited to repayment of the amount of the available funds.

14.3 If You have used Your Card or allowed Your Card to be used fraudulently, in a manner that does not comply with these terms and conditions, for illegal purposes, or if You have allowed Your Card or details to be compromised due to negligence You will be held responsible for the use and misuse of the Card. We will take all reasonable and necessary steps to recover any loss from You, and there shall be no maximum limit to Your liability except where relevant laws or regulations impose such a limit. This means You should take care of Your Card and details and act responsibly, or You will be held liable.

14.4 The Card is issued entirely at Your own risk. We shall bear no liability whatsoever for any loss or damage, financial or otherwise, arising from the issuance of the Card, howsoever caused. Use of the card for any transaction shall be at Your sole risk. By using the Card, You are assuming all financial risks incidental to or arising out of the Cards usage with no further liability to us.

15. YOUR PERSONAL INFORMATION
15.1 We collect certain information about the purchaser and the users of the Card in order to operate the Card programme.

15.2 We may transfer your data outside the UAE to our commercial partners for the purposes of providing customer service, account administration, financial reconciliation, or other valid reasons needed to provide Our services to You. When we transfer data outside the UAE, we will take steps to ensure that Your data is afforded the same or equivalent protection as data processed within the UAE. Your use of Our products and services will indicate to Us that you agree.

15.3 By purchasing the Card, You agree that We can communicate with You by email and/or telephone and/or SMS.

16. CHANGES TO THESE TERMS AND CONDITIONS
16.1These Terms and Conditions may be changed or amended without any prior notice at our sole discretion at any time for legal, regulatory or security reasons or to enable the proper delivery of or to improve the delivery of the Card scheme. If any changes are made copies of the revised Terms and Conditions will be made available online at www.teensclubculture.ae

16.2 It is Your responsibility to check the website www.teensclubculture.ae regularly for changes to terms & conditions. We will assume that You have done so, and will be entitled to assume You have accepted any changes to these terms & conditions unless You notify Us otherwise. We will deal with any such circumstances on a case-by-case basis.

17. LAW AND COURTS
17.1 The issue and use of the Card and these terms and conditions are governed by the Federal laws of the United Arab Emirates and the local laws of Abu Dhabi.

17.2 Any dispute or difference between Us and You arising in respect of the Card or these Terms and Conditions will be submitted to resolution by the civil courts of the United Arab Emirates and the Dubai International Financial Centre (DIFC) courts.

Additional Terms

The content on the TCC website is for information only. TEN is not responsible for the accuracy of any material provided by participating venues, reviewer or TCC Reps.

TEN will not have any contractual or financial involvement with bookings made by members of TCC with participating venues for Special Events or day to day visitation to the venues. Should a member have a negative experience at any of the participating venues then members should advise TEN who will endeavour to assist in resolving any issues, however TEN are not obliged to resolve issues nor compensate any TCC members for any bad experiences or compensate in any way for any benefits that are not delivered by participating venues.

TEN reserve the right to amend these terms and conditions at anytime without advising members other than by republishing new terms and conditions on the TCC website.

The above terms and conditions, and any agreement entered into in connection with the promotion of special events through TCT, shall be interpreted in accordance with the Laws established by the Dubai Courts.

Limitation of Liability

By agreeing to these Terms and Conditions and signing up for TCC Membership, you understand and agree that TEN, or any of our directors, officers, agents, employees, sponsors, TCC event venues, TCC partners, suppliers and/or other TCC associates or representatives will not be liable for damages arising out of or in connection with the TCC event promotional website, attendance at any TCC events staged by participating venues or any TCC services, this includes but is not limited to any kind of damages, direct, indirect or consequential loss, personal injury, loss of profit, damage to personal or company property, loss of data or loss of goodwill (in all these cases whether direct or indirect) nor any indirect, economic, consequential or special loss and any claims by any 3rd party.
